The Maharashtra Real Estate and Regulation Act 2016 deals exclusively against builders
and is enforced all over India. The Real Estate and Regulation Act 2016 is in force in
all the States and Union territories in India.
Now dealing against Builder means what?
A question arises in our mind as to what are the complaints decided by Rera Court/
Tribunals. In very simple terms that is to say under the Relevant Provisions of the
Act which declares and states that the Builder through an Agreement of Sale/Allotment
letter which is made and is not giving the possession to the flat purchaser, then
the flat purchaser can claim the possession of the Flat premises and has the right
to claim the interest on the amount paid to the builder at the MCLR rate of interest
(Marginal Cost Lending Rate) + 2% penalty from the date of making payments to the
builder or from the date of possession till the builder hands over the possession of
the premises to the Allottee/purchaser. Further in a very simple terms the Act also
States that if the Allottee/Purchaser intends to withdraw from the project then in
that event he can also demand the refund of the price consideration of the flat with
interest.
The Rera Complaints Guidance Cell provides guidance to whoever intends to seek guidance and may be a
resident either in Maharashtra or from any other State all over India to file their respective
complaints against Builders in the Rera Courts/Appellate Tribunals.

Today he is renowned Advocate and Notary in Bombay High Court. He can speak Marathi, Hindi, English, Gujarathi, Punjabi and Bangla languages. His concern for building social awareness has resulted, in him working in different capacities.
Adv. Rajeshwar Deshmukh has completed his B.S.L-LL.B. having passed in 'First Class' from
University of Poona in April, 1990.
Mr. Deshmukh is the Founder and Treasurer of both, "The Consumer's Guidance
and Protection Society" and "RERA Complaints and Guidance Cell." He has been exclusively practicing
in Property
and Consumer Matters since last 32 years and has also been
practicing in MahaRERA Court & RERA Appellate Tribunal since the
Real Estate and Regulation Act came into force.
Miss Anushka Deshmukh has completed her schooling from Smt. Sulochanadevi Singhania School in
Thane. She is currently in her 4th year, pursuing her B.B.A-LL.B. (Hons) Degree from Mumbai
University.
She has been interning with the Chambers of Mr. Deshmukh since her 1st year of Law School
and has expertise in Legal Drafting, Property Matters, Divorce cases and handling clientele.
